1. PERMITTED USE

1.1 You, as an anyAWOS subscriber, who agrees to these terms and conditions for the use of anyAWOS, have the means to access anyAWOS service from any telephone, through use of your registered telephone number and Personal Identification Number (PIN). You may use anyAWOS only for your individual, lawful purposes. Any other use of anyAWOS is not permitted. You may not assign or otherwise transfer your access to another user. You are responsible for maintaining the secrecy of your PIN, and are expected to take reasonable action to protect access to your account.

1.2 an anyAWOS subscription authorizes a single individual to use the service. A multi-user (called corporate) subscription is required from anyAWOS if more than one individual user requires access to anyAWOS. The multi-user subscription is available by calling anyAWOS at 517-268-1286.

1.3 Use of any type of continuous, automated access to the service (such as computer auto-dialing) is prohibited.

1.4 Subscriptions are intended for unmeasured but reasonable usage. anyAWOS reserves the right to review a subscription’s use, and, at its discretion, if anyAWOS determines that the subscription is being used unreasonably, including, but not limited to, violations of sections 1.2 and 1.3 above, then anyAWOS reserves the right to contact the subscriber to address the situation, and at its discretion, cancel said subscription which is in violation of this agreement.

2. PAYMENT METHODS

2.1 Subscriptions are paid by credit card, either by signing up on our secure web server (which you are on now), or by calling us at 517-268-1286. Credit card numbers and other personal information are never transmitted without encryption, and are never used for any purpose other than paying for your subscription.

2.2 Subscribers may pay monthly. If you select monthly payments, you agree that we may continue to charge your credit card each month, until such time as you notify us that you want to terminate your subscription. There will be no refunds for partial months.

2.3 Subscribers may pay yearly. If you select yearly payments, you will be charged the yearly fee at the time of sign-up, which entitles you to service for one year. If during the course of the year you decide you want to cancel the service, there will be no refund for any remaining unused time. Within 30 days of your subscription expiring, in order to maintain the continuity of your anyAWOS service, we will notify you of our intent to charge your credit card for another year. If you do not wish to renew, you will notify us not to charge your credit card before the subscription expiration date.

3. GENERAL

3.1 anyAWOS service maintains a current database of AWOS locations and phone numbers in the United States, and provides subscribers access to the instant, real-time weather observations at those locations. anyAWOS also obtains Terminal Area Forecasts (TAF’s) in raw form from the National Weather Service, and interprets and voices those forecasts to subscribers. Mackinac Software, LLC and anyAWOS are not responsible for the accuracy of such information, nor for any damages caused by information products obtained on this system, either as a result of information supplied to us or as a result of any actions or inaction taken by the anyAWOS system.

3.2 anyAWOS service is typically available 24 hours a day, seven days a week. Although every effort is made to keep the service active at all times, delivery of information is not guaranteed, and Mackinac Software, LLC and anyAWOS are not responsible for any damages resulting from lack of availability.

3.3 By using the service, the user assumes the entire risk related to their use of the information provided by anyAWOS. anyAWOS is providing the information “as is”, and anyAWOS disclaims any and all warranties, whether express or implied, including (without limitation) any implied warranties of merchantability or fitness for a particular purpose. In no event will anyAWOS or Mackinac Software, LLC be liable to the subscriber or to any third party for any direct, indirect, incidental, consequential, special, or exemplary damages or lost profit resulting from any use or misuse of this data.
